Terms of Service

1. The Service

RealQube provides AI-assisted marketing tools for real estate professionals, including AI-generated websites, SEO blog content, Google Business Profile post drafting and publishing, keyword rank tracking, and analytics. Features may change, be added, or be removed over time.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity under your account. Notify us promptly of any unauthorized use.

3. Subscriptions, billing, and refunds

The Service is offered on a subscription basis through plans described at https://realqube.com (for example, Starter, Pro, and Enterprise). By subscribing, you authorize us and our payment processor, Stripe, to charge your payment method on a recurring basis until you cancel.

• Fees are billed in advance and are non-refundable except where required by law.
• You can cancel at any time from your account; cancellation stops future renewals and takes effect at the end of the current billing period.
• We may change pricing with reasonable advance notice. Changes apply to billing periods after the notice.

4. Connected Google services

If you connect a Google account, Google Business Profile, or Google Analytics, you authorize RealQube to access and act on that data to provide the features you request — for example, drafting and publishing Google Business Profile posts and retrieving performance metrics. You represent that you are an owner or authorized manager of any Google Business Profile or property you connect. Your use of Google services is also subject to Google's own terms. You can disconnect Google access at any time.

5. AI-generated content

The Service uses AI to generate websites, articles, posts, and other content. AI output may contain inaccuracies and is provided to assist you. You are responsible for reviewing all content before publishing it and for ensuring it is accurate, lawful, non-misleading, and compliant with real estate advertising rules, fair housing laws, and any applicable professional or MLS requirements. As between you and RealQube, content you generate and publish is your content and your responsibility.

6. Acceptable use

You agree not to:

• use the Service to violate any law or third-party rights;
• publish false, misleading, discriminatory, or unlawful content, including content that violates fair housing laws;
• attempt to disrupt, reverse engineer, or gain unauthorized access to the Service;
• resell or provide the Service to third parties except as permitted by your plan; or
• use the Service to send spam or violate Google's or any platform's policies.

We may suspend or terminate accounts that violate these Terms.

7. Your content and license

You retain ownership of the business information and content you provide or generate ("Your Content"). You grant RealQube a non-exclusive, worldwide license to host, process, and display Your Content solely to operate and provide the Service, including transmitting it to the third-party providers needed to deliver features (such as AI generation, publishing to Google, and analytics).

8. Intellectual property

The Service, including its software, design, and branding, is owned by RealQube and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your business during your subscription. You may not copy, modify, or create derivative works of the Service itself.

9. Third-party services

The Service integrates with third parties including Google, Stripe, Supabase, Vercel, Anthropic, and SerpApi. We are not responsible for third-party services, and your use of them is governed by their respective terms and policies.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that AI-generated content will be accurate or produce any particular marketing, ranking, or business result.

11. Limitation of liability

To the maximum extent permitted by law, RealQube and Vercelliere Verger LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim arising from the Service will not exceed the amount you paid us in the twelve months before the claim.

12. Indemnification

You agree to indemnify and hold harmless RealQube and Vercelliere Verger LLC from any claims, damages, or expenses arising from Your Content, your use of the Service, or your violation of these Terms or applicable law.

13. Termination

You may stop using the Service and cancel at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Upon termination, your right to use the Service ends; sections that by their nature should survive (including ownership, disclaimers, limitation of liability, and indemnification) will survive.

14. Changes to these Terms

We may update these Terms from time to time. We will post the updated version with a new "Last updated" date and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the revised Terms.

15. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any disputes will be resolved in the state or federal courts located in California, unless otherwise required by applicable law.
