Terms of Service

1. What RealQube is

RealQube gives real estate agents AI written weekly articles published to their own WordPress site, Google Business Profile posting, review import and reply drafting, keyword rank tracking, a view of competing agents in your market, and a leads inbox. RealQube connects to your WordPress site using an application password that you create and can revoke at any time. We store it encrypted and use it only to publish and update the articles you approve or schedule. We do not host your website; legacy RealQube hosted pages for older accounts may remain until they are retired. Features are added, changed, and sometimes removed as the product develops. We will tell you about material changes that affect a feature you pay for.

2. Who can use it

You must be at least 18 years old and able to enter a binding contract. RealQube is built for licensed real estate professionals and the people who work with them. You are responsible for keeping your login secure, for the accuracy of the details you give us, and for everything that happens under your account. 3. Free accounts and the paid plan

You can create a free account without a card. Free accounts can explore the dashboard and use up to five free AI generations. The paid plan is one plan at $97 per month, billed monthly in advance through our payment processor, Stripe. There are no tiers, setup fees, or minimum terms. A free account never converts to paid on its own; you are charged only when you choose to upgrade.

When you subscribe you authorize Stripe to charge your payment method each month until you cancel. You can cancel at any time from your dashboard. Cancellation stops future charges and your paid features stay active until the end of the billing period you have already paid for. If we change the price we will email you at least 30 days before the new price applies, with instructions for cancelling if you would rather not continue.

4. The 60 day money back guarantee

If RealQube is not worth it to you, email realqubeseo@gmail.com from the address on your account within 60 days of your first subscription payment and we will refund every payment you made in those first 60 days, in full, to the original payment method within 10 business days. No reason is required. The guarantee applies once per customer, on your first subscription. After the 60 days, payments are not refundable, but you can cancel at any time and will not be charged again. The full wording is on our Refund Policy page, and if that page and these Terms ever differ, the Refund Policy applies.

5. Your website and the articles we publish

When you approve or schedule an article, RealQube publishes it to your own WordPress site through the application password you gave us. Your website is yours and is hosted by you or your provider, not by RealQube. RealQube is the platform. You are the publisher of your site and of every page, post, listing description, and review reply that appears on it or goes out under your name. That means you are responsible for making sure the content is accurate and lawful, follows fair housing law and the advertising rules of your state licensing board, brokerage, and MLS, includes the license and brokerage disclosures your state requires, and does not use photos, logos, or text you do not have the right to use.

We may remove or unpublish content that we reasonably believe breaks the law, these Terms, or a platform policy we rely on, and we will tell you when we do.

6. AI generated content

RealQube uses AI models, including Anthropic's Claude, to draft websites, articles, Google Business Profile posts, review replies, and other copy from the details you give us. AI drafts can be wrong, out of date, or unsuitable for your market. Review every draft before you publish it, and edit anything that is not true for you. Once you publish a draft it is your content, exactly as if you had written it yourself.

We do not guarantee search rankings, Google Business Profile visibility, traffic, leads, appointments, or sales. Nobody can control what Google shows, and we do not claim to. The only promise we make about results is the money back guarantee in Section 4.

7. Connected Google services

If you connect your Google Business Profile, you give RealQube permission to use Google's business.manage scope to read your profile details and reviews, publish posts you create or schedule, post the replies you approve, and read performance data. You confirm that you own or are an authorized manager of any profile you connect. Your use of Google is also governed by Google's own terms. You can disconnect from the Google Business Profile page in your dashboard at any time, and you can revoke RealQube's access from your Google account permissions page. Our Privacy Policy explains how we handle Google data.

8. Acceptable use

Please use RealQube the way it was designed to be used. You agree not to:

• send spam, bulk unsolicited messages, or anything that violates CAN-SPAM, the TCPA, or Google's policies;
• publish content that discriminates or signals a preference based on race, color, religion, national origin, sex, familial status, disability, or any other protected class, or that otherwise breaks fair housing law;
• publish content that is false, misleading, defamatory, or that infringes anyone's copyright, trademark, or privacy;
• scrape, crawl, or bulk export the Service, other agents' sites, or the data behind them, or use automated tools to load the Service beyond normal use;
• resell, sublicense, or share your account, or use RealQube to provide services to other agents as if it were your own product;
• interfere with the Service, probe its security, or try to reach data that is not yours; or
• use the Service for any purpose that is unlawful or that harms other people.

If you break these rules we may suspend or close your account, and we may remove the content involved.

9. Your content and our license to run it

You own the business information you enter and the content you publish through RealQube, including your leads. So we can run the Service, you give us a non-exclusive, worldwide license to store, process, display, and transmit that content, which includes sending it to the providers we rely on: Anthropic for AI drafting, Google when you ask us to publish or import, your own WordPress site when we publish your articles, Stripe for billing, Resend for email, and Supabase and Vercel for hosting. That license ends when you delete the content or close your account, except for copies kept in routine backups for a limited time.

10. Leads and visitor data on your site

Visitors to your agent site can send you their name, email, phone, and a message. Those leads belong to you and appear in your dashboard. You agree to use them only to respond to the person who reached out, to follow the laws that apply to contacting them, and to honor any request they make to stop. RealQube records simple visit analytics on your site (page path, referrer, and campaign tags) so you can see where traffic comes from. We do not set cookies on visitors.

11. Referral program

RealQube offers a referral program in the dashboard. Referral rewards are described on the referral page, are paid only for referred customers who keep an active paid subscription, and can be withheld or reversed for self referrals, refunded accounts, or fraud. We may change or end the program with notice.

12. Our intellectual property

The RealQube software, design, brand, and templates belong to Vercelliere Verger LLC. While your account is in good standing you may use them to run your own marketing. You may not copy the Service, build a competing product from it, or remove the small RealQube credit that appears in the footer of hosted sites.

13. Service availability

We work to keep RealQube online and fast, but we do not promise it will be available without interruption. Maintenance, provider outages at Google, Stripe, Vercel, Supabase, or Anthropic, and problems outside our control can make the Service unavailable for a time. When a paid feature is down for an extended period we will tell you what happened, and we may issue credit at our discretion.

14. Ending your account

You can cancel your subscription or ask us to delete your account at any time. When a paid subscription ends, we stop publishing to your WordPress site after the final billing period, and any legacy RealQube hosted pages stop being served. Articles already published to your WordPress site stay there, because it is your site. We keep your account data for 60 days after cancellation so you can export it or come back, then delete or anonymize it, except where we must keep records for legal, tax, or security reasons.

We may suspend or close your account if you break these Terms, if we must in order to protect other users or the Service, or if a provider we depend on requires it. Where we can, we will warn you first and give you a chance to export your content. Sections that by their nature should continue after the account ends (ownership, disclaimers, limitation of liability, indemnity, and governing law) do continue.

15. Disclaimers

The Service is provided as is and as available. To the extent the law allows, we make no warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error free, that AI drafts will be accurate, or that using RealQube will produce any particular ranking, traffic, lead, or business result.

16. Limitation of liability

To the maximum extent permitted by law, Vercelliere Verger LLC and RealQube will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost deals, or lost data, arising from the Service or these Terms. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim arose, or $97 if you have paid nothing. Some states do not allow these limits, so parts of this section may not apply to you.

17. Indemnity

If someone brings a claim against us because of content you published, leads you contacted, a Google profile you connected, or a breach of these Terms or the law, you agree to defend us and cover the resulting costs, including reasonable legal fees.

18. Governing law and where disputes are heard

These Terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute that we cannot resolve by talking it through will be brought in the state or federal courts located in San Diego County, California, and you and we each agree to the personal jurisdiction of those courts. If you are a consumer in a place whose law gives you the right to sue at home, nothing here takes that right away. Before filing anything, please email us; most problems can be fixed in a day.

19. Changes to these Terms

We may update these Terms as the product changes. When we do, we will post the new version here with a new effective date, and for material changes we will email the address on your account at least 14 days before they take effect. Continuing to use RealQube after that date means you accept the new Terms. If you do not, cancel before the change takes effect.

20. Other things worth stating

These Terms, the Privacy Policy, and the Refund Policy are the whole agreement between you and us about RealQube. If a court finds one part unenforceable, the rest stands. If we do not enforce a term right away, we can still enforce it later. You may not transfer your account to someone else without our written consent; we may transfer this agreement as part of a merger, acquisition, or sale of the business, and we will tell you if that happens.
